StoneSwap Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by 17524218 CANADA INC. (operating as "StoneSwap", "we," "us," or "our") at stoneswap.ai, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Service Description and "AS-IS" Nature

StoneSwap provides Artificial Intelligence (AI) powered tools for hardscape visualization. You explicitly understand and agree that:

• No Guarantee of Accuracy: AI generations are probabilistic estimates. We do not guarantee that the generated images will accurately represent real-world physics, material colors, textures, or structural feasibility.
• Visualization Only: The output is for conceptual visualization purposes only. It is NOT a construction plan, blueprint, or architectural drawing.
• Services Provided "AS-IS": The service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, whether express or implied.

3. Limitation of Liability regarding Construction

You agree that StoneSwap and 17524218 CANADA INC. are NOT LIABLE for any disputes, refunds, or damages arising between you and your clients.

Specifically, we are not liable if:

• A physical installation does not match the AI-generated visualization.
• A client refuses to pay you based on discrepancies between the AI image and the final result.
• Material costs or availability differ from what is visually represented.

You assume full responsibility for managing your client's expectations. You must inform your clients that these are AI visualizations and not guarantees of final results.

4. Refund Policy

Due to the high computational costs associated with GPU processing, we do not offer general refunds. However, we may consider refunds under strict conditions:

• Request Method: You must email refunds@stoneswap.ai with your login email and the specific transaction date.
• Time Window: The request must be made within 3 days of the transaction date.
• Usage Cap: You must NOT have used more than 10 Renders from the purchased batch.
• Usage Freeze: Once a refund is requested, you agree not to use more than 10 Renders while the request is being processed. Exceeding this limit voids the refund request.

If these conditions are not met, the sale is final.

5. Lead Data and Embedded Tools

If you use our "Embed" feature to place our visualizer on your website:

• We process and store all lead information (names, emails, photos, project details) collected through the tool.
• You grant us a worldwide, perpetual, irrevocable license to use, store, analyze, and monetize this data for our own business purposes, including but not limited to model training, marketing, and data aggregation.

6. AI-Generated Content Ownership

• Ownership: Subject to your compliance with these terms, you own the rights to the images you generate.
• Liability: You are solely responsible for the content you upload and generate. You agree not to use the service for illegal, defamatory, or infringing purposes.

7. Limitation of Liability

To the fullest extent permitted by law, 17524218 CANADA INC. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the last 12 months.

8. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice and without refund, for conduct that we believe violates these Terms, is harmful to other users, or for any other business reason.

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.
